1. Acceptance of terms

By installing or using xUpsell from the Shopify App Store, you agree to be bound by these Terms of Service.

2. Service description

xUpsell runs your marketing for Shopify including email, SMS, browser push, offers right after checkout, multi-step automations, AI written content, and revenue analytics.

3. Pricing and payment

xUpsell uses flat monthly pricing billed through Shopify. All plans include zero per-send fees. Third-party costs (Twilio, AI providers) are billed separately.

4. Acceptable use

You must use xUpsell for lawful marketing purposes in compliance with anti-spam laws. You must obtain consent before sending marketing communications.

5. Third-party integrations

You are responsible for maintaining valid accounts with third-party providers (Gmail, Outlook, SendGrid, Twilio, AI providers).

6. Limitation of liability

xUpsell is not liable for indirect damages. Total liability shall not exceed fees paid in the preceding twelve months.

7. Governing law

Governed by the laws of Quebec, Canada. Disputes resolved through binding arbitration in Montreal.
